Welcome to Pop Coin ("we," "us," or "our"). These Terms & Conditions ("T&Cs") govern your use of the Pop Coin loyalty application ("App") operated by Pop Coin Technologies, a company registered in Pune, Maharashtra. By accessing or using our App, you agree to be bound by these T&Cs. 

1. Eligibility

- You must be at least 18 years old to register and use the App.
- By using the App, you confirm that you meet all eligibility criteria.
- The App is intended for personal use only and not for commercial use.

2. Registration and Account Security

- To redeem or earn Pop Coins, you must create an account using valid information.
- You are responsible for maintaining the confidentiality of your login credentials.
- Any activity under your account is your sole responsibility.

3. Use of the App and Rewards

- Pop Coins can be earned at participating merchant outlets as per the merchant’s specific terms.
- Rewards, i.e., redeemable Pop Coins, can be redeemed at participating merchants as per the redemption process provided within the App.
- We reserve the right to modify, suspend, or terminate the rewards system at any time without prior notice.

4. Redemption and Expiry

- Pop Coins do not have any expiry date.
- Redemption is subject to the availability of rewards and merchant participation.
- We are not responsible for an issues arising from merchant-specific restrictions or policies.

5. Merchant Participation

- Participating merchants are bound by their own terms and conditions.
- We do not guarantee the availability, quality, or any aspect of merchant services or products.

6. Customer Data and Privacy

- Your data will be handled in accordance with our Privacy Policy.
- By using the App, you consent to the collection, use, and sharing of your data as described.

7. Intellectual Property

- All content within the App, including logos, trademarks, and text, are the property of Pop Coin Technologies or its licensors.
- You may not copy, modify, or distribute any content without prior written permission.

8. Limitation of Liability

- We are not liable for any damages resulting from the use or inability to use the App or redeem rewards.
- We do not guarantee continuous or error-free operation of the App.

9. Amendments to Terms

- We reserve the right to modify these T&Cs at any time. Changes will be effective upon posting on the website.
- Continued use of the App constitutes acceptance of amended terms.

10. Governing Law and Jurisdiction

- These T&Cs shall be governed by the laws of Pune, Maharashtra.
- Any disputes shall be subject to the exclusive jurisdiction of courts in Pune.

- We implement appropriate technical and organizational measures to protect your data against unauthorized access, alteration, disclosure, or destruction.
- However, no system is entirely secure; therefore, we cannot guarantee absolute security.

5. Data Retention

- We retain your information for as long as necessary to provide our services and comply with legal obligations.
- You may request deletion of your Data by contacting us, subject to legal restrictions.

6. Your Rights

Refund & Cancellation Policy

This Refund & Cancellation Policy outlines how refunds and cancellations are handled in relation to the [Loyalty Program Name] (“Program”), where customers earn and redeem loyalty points i.e. Popcoins (“points”) across our merchant network.

1. General Terms

  • Points earned through eligible purchases are credited to a customer’s loyalty account.

  • Points redeemed against purchases are deducted from the customer’s account at the time of redemption.

  • Points have no monetary value and cannot be exchanged for cash, unless explicitly stated by applicable laws.

2. Refunds on Purchases (Earning Transactions)

  • If a customer cancels or returns a purchase for which Points were awarded, the Points earned from that transaction will be reversed.

3. Refunds on Redemptions

  • Once Points are redeemed (partially or fully) against a purchase, those Points are considered “used” and cannot be reinstated unless:

    • The merchant cancels the order before delivery/fulfilment, or

    • The product/service is unavailable and no replacement is offered.

  • In such cases, Points will be credited back to the customer’s loyalty account within 7 working days.

4. Partial Payments (Points + Cash)

  • Where a transaction involves both Points and cash/card:

    • The cash/card portion will be refunded

    • The Points portion will be reinstated to the customer’s account if the refund conditions (as above) are met.

5. Cancellations by Customers

  • Customers may cancel eligible orders as per the merchant’s cancellation policy.

  • If the order is cancelled before fulfilment:

    • Cash/card payments (if any) will be refunded as per merchant terms.

    • Redeemed Points will be credited back to the loyalty account.

6. Cancellations by Merchants

  • In case a merchant cancels an order, the customer will receive:

    • A full refund of the cash/card portion (if any), and

    • Restoration of redeemed Points to their loyalty account.

7. Disputes & Exceptions

  • Any disputes regarding Points crediting, redemption, or reversal must be raised within 14 days of the transaction.

  • The Program reserves the right to adjust, withhold, or reverse Points in cases of suspected fraud, misuse, or error.

8. Policy Changes

  • Pop Coin reserves the right to update or modify this Refund & Cancellation Policy at any time. Changes will be communicated via [App/Website/Email].
